Rules
1. Contest
Description:
As-Seen-On-TV
OnLine Contest ("Contest") is a contest in which participants
qualify for a prize by submitting an entry. Winners will be chosen by a random
drawing from the entries received each month. Winners will be selected by the
15th of each month for entries received for the prior month. Name of winners
can be obtained by writing to Contest, 1800shoptv.com Contest, Permission
Interactive, Inc. 6070 Mission Gorge Road, Suite 1, San Diego, CA 92120. No Purchase
or Internet Access Necessary to Win.
2. Eligibility:
The
Contest is open to legal residents of the United States who are 18 years of
age or older at the time of entry. Void in Puerto Rico and where prohibited
by law. Employees and consultants of Permission Interactive, and their
immediate families (immediate family defined as parent, sibling or any person
residing in the same household) and their parents, affiliates, subsidiaries,
advertising and promotion agencies are not eligible to participate. The odds
of winning depend upon the number of entrants received.
3. How to Play:
To
enter the Contest via the Internet, you must have signed up with Permission
Interactive on its website 1800shoptv.com at the time of entry. To enter
without Internet access, either call toll-free at 1-800-300-5307, Monday through
Friday 10:00 am – 9pm PST or mail a plain 3” x 5” piece of paper on which you
have hand-printed your name, address, zip code, telephone number, e-mail address
(optional). Mail entry to: 1800shoptv.com Contest c/o Permission
Interactive, 6070 Mission Gorge Road, Suite 1, San Diego, CA 92120.
Limit one entry per person. Not responsible for lost, late or misdirected
mail. All entries must be received by the 28th of the month at 12:00 AM PST
to qualify for the drawing to take place on the 15th of the following month.
Winners will be notified by mail and/or e-mail within ten (10) days following
the drawing date.
4. Prizes:
One
entrant will be selected to win one As-Seen-On-TV (approximate retail values
ranging from $19 to $100). Permission Interactive provides no warranties
with respect to the prizes, and HEREBY DISCLAIMS ALL IMPLIED WARRANTIES, including
without limitation implied warrant of merchantability and fitness for a particular
purpose.
5. General
Conditions:
By
entering, you agree to abide by the terms of these official rules and by the
decisions of Permission Interactive (the "Sponsor") which are
final and binding on all matters pertaining to this Contest. The operation of
the Contest and interpretation of these rules is governed by the laws of the
United States. All federal, state, local laws and regulations apply. Income
taxes are the responsibility of the winners. No substitution or transfer of
prizes permitted except by Permission Interactive. Return of any prize/prize
notification as undeliverable may result in disqualification and selection of
an alternate winner. Entrants further grant to Sponsor the right to use and
publish their proper name and state on line and in print in any other media
in connection with the Contest. Acceptance of a prize constitutes permission
for Sponsor to use winner's name and likeness for advertising and promotional
purposes without additional compensation unless prohibited by law. By entering,
participants release and hold harmless Sponsor, its respective parents, subsidiaries,
affiliates, directors, officers, employees and agents from any and all liability
or any injuries, loss or damage of any kind arising from or in connection with
this Contest or any prize won.
6. Internet:
If
for any reason the Internet portion of the program is not capable of running
as planned, including infection by computer virus, bugs, tampering, unauthorized
intervention, fraud, technical failures, or any other causes beyond the control
of Sponsor which corrupt or affect the administration, security, fairness, integrity,
or proper conduct of this Contest, Sponsor reserves the right at its sole discretion,
to disqualify any individual who tampers with the entry process, and to cancel,
terminate, modify or suspend the Contest. In such event Sponsor further reserves
the right to conduct a drawing to award the Prizes using all eligible entries
received as of the termination date. Sponsor assumes no responsibility for any
error, omission, interruption, deletion, defect, delay in operation or transmission,
communications line failure, theft or destruction or unauthorized access to,
or alteration of, entries. Sponsor is not responsible for any problems or technical
malfunction of any telephone network or lines, computer on line systems, servers,
or providers, computer equipment, software, failure of any e-mail to be received
on account of technical problems or traffic congestion on the Internet or at
any Web site, or any combination thereof, including any injury or damage to
participant's or any other person's computer related to or resulting from participation
or downloading any materials in this Contest. Entrants may not play with multiple
e-mail addresses nor may entrants use any other device or artifice to play multiple
times or as multiple entrants. Any entrant who attempts to play with multiple
e-mail addresses under multiple identities or uses any device or artifice to
play multiple times, will be disqualified. CAUTION: ANY ATTEMPT BY A CONTESTANT
TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF
THE GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT
BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT
TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute, entries made
by Internet will be declared made by the authorized account holder of the e-mail
address submitted at time of entry. "Authorized account holder" is
defined as the natural person who is assigned to an e-mail address by an Internet
access provider, on line service provider or other organization (e.g., business,
educational, institution, etc.) that is responsible for assigning e-mail addresses
for the domain associated with the submitted e-mail address.
